Who we are

CheckMyClaims is operated by Vantage Thinking (ABN 92 745 878 359), an Australian registered business. In this policy, "we", "us" and "our" refer to that entity.

We are an independent lead generation service that helps Australians check their eligibility for class action lawsuits. We are not affiliated with Omni Bridgeway, JGA Saddler Lawyers, or Johnson & Johnson. We do not provide legal advice.

This policy describes how we comply with the Privacy Act 1988 (Cth) and the 13 Australian Privacy Principles (APPs).

Eligibility (18+)

This service is intended only for Australian residents aged 18 or over. The eligibility form requires you to confirm you are 18 or over before submitting. We do not knowingly collect personal information from anyone under 18. If you believe we have inadvertently collected information from a minor, please contact privacy@checkmy.claims and we will delete it.

What data we collect

If you complete our eligibility check and choose to submit your details, we collect:

Sensitive information & explicit consent

The information you provide about cold & flu products you purchased and used falls within the definition of "sensitive information" (specifically, health information) under section 6 of the Privacy Act 1988 (Cth). Sensitive information attracts higher protection than ordinary personal information under Australian Privacy Principle 3.3.

By submitting the eligibility form (after ticking the consent checkbox), you provide your explicit consent for us to collect this sensitive information for the sole purpose of registering you as a group member in the J&J Cold & Flu class action. You may withdraw this consent at any time by emailing privacy@checkmy.claims; on receipt we will request that Omni Bridgeway and JGA Saddler Lawyers also delete your data, subject to any class-action record-keeping obligations they may have.

We will not use your health information for any purpose other than the class action registration described in this policy.

How we use your data

Your data is collected for the sole purpose of registering you for the J&J Cold & Flu Class Action, funded by Omni Bridgeway and run by JGA Saddler Lawyers.

Tracking and analytics

We use the Meta Pixel (from Meta Platforms, Inc. — the company behind Facebook and Instagram) to measure the performance of our advertising and improve our eligibility-check experience.

When you visit this site, Meta Pixel sends the following to Meta:

Meta Pixel does not transmit your name, email, or phone number. Those details are sent only to Omni Bridgeway and JGA Saddler Lawyers as described above.

Meta's handling of any data they receive is governed by their own privacy policy: facebook.com/privacy/policy. You can control or opt out of Meta's tracking in your Facebook account settings, or via your browser's tracking-protection features.

Data storage

Your data is stored on encrypted servers (TLS in transit, AES-256 at rest). Access is restricted to a single administrator account and protected by multi-factor authentication. We log access to the registration database and retain those logs for audit purposes.

Data breach response

We comply with the Notifiable Data Breaches scheme under Part IIIC of the Privacy Act 1988 (Cth). If we become aware of an "eligible data breach" — that is, an unauthorised access or loss of personal information that is likely to result in serious harm — we will:

How long we keep your data (retention)

In accordance with Australian Privacy Principle 11.2, we retain your registration data only for as long as it is reasonably necessary for the purpose described in this policy:

We may retain a minimal anonymised audit record (e.g., timestamp, hashed identifier, "registered with OB: yes/no") indefinitely for the purpose of compliance reporting and fraud detection. This audit record cannot be used to re-identify you.

Your privacy rights

Under the Australian Privacy Principles, you have the following rights in relation to your personal information. Each can be exercised by emailing privacy@checkmy.claims from the email address you used at registration (or with sufficient verification of identity). We will respond within 30 days.

Changes to this policy

We may update this policy from time to time. The "Last updated" date at the top of this page reflects the most recent material change. If we make changes that materially affect how we handle your data, we will notify registered users by email at the address you provided. Continued submission of new data after a change constitutes acceptance of the updated policy. Past versions are available on request.

Jurisdiction & non-Australian visitors

This service is intended for residents of Australia only. The class action it relates to (J&J Cold & Flu) is an Australian proceeding open to Australian residents. We do not market, advertise, or solicit submissions from outside Australia.

If you are visiting from the European Union, the United Kingdom, the United States (including California), or any other jurisdiction outside Australia, you should not submit personal data through this site. We do not represent that this service is suitable for, or compliant with, the data protection laws of jurisdictions outside Australia (including but not limited to the EU/UK GDPR or the California Consumer Privacy Act).

If you submit data to us from outside Australia, you do so at your own risk and acknowledge that your information will be handled in accordance with this policy and the Australian Privacy Act 1988 (Cth), and may be transferred to or accessed from Australia for the purposes described above.
